"Her kids are no longer here. She walks around all day with that right here in her face, every single solitary day. And then she sleeps and has horrible dreams about this," Clancy's lawyer said.

Lindsay Clancy has been on constant suicide watch since she allegedly killed her children three and a half years ago, one of her attorneys told CBS News in a report published on Monday.

According to the attorneys, named Rosemary Scapicchio, Clancy "wants to be with her children."

"Her kids are no longer here. She walks around all day with that right here in her face, every single solitary day. And then she sleeps and has horrible dreams about this," Schapicchio said.

Clancy is due in court on Monday morning to learn if she will be tried a second time in the strangling deaths of 5-year-old Cora, 3-year-old Dawson and 8-month-old Callan, a tragedy her attorney said occurred while she was suffering from postpartum psychosis.

Her first trial ended in a mistrial in September.

Clancy held in psychiatric facility

Clancy is currently being held in a state psychiatric facility. She was paralyzed after falling out of a second-story window the night of the killings.

She is suing 11 medical professionals who her lawyers alleged failed to properly diagnose and treat her when she sought help in the months before the tragedy.

Scapicchio said that the case could enable Clancy to live independently.

"She's locked up in a facility. ... She can't do anything for herself, and she doesn't want to be in a position where she's a burden to anyone when the criminal trial is over. And so part of what we want to do for her, in the civil case, is make sure that there's enough money, so she can live independently," Scapicchio told CBS.

Attorney Andrew Meyers said that there was "no question" that Clancy was suffering from postpartum psychosis the night of the killings, and criticized one of the defendants in the civil case, psychiatrist Jennifer Tufts, who testified at Clancy's criminal trial.

Tufts spoke to Clancy during a telehealth appointment the day before the killings and testified to not believing Clancy was suffering from psychosis in court.

"I think there are certain things she said and certain things she actually recorded in the records, that are going to come back to haunt her terribly in this civil trial," Meyer said.

Civil case brings hope of helping other women

Clancy's lawyers said that the civil case also gives her hope.

"If we save one other child, if we save one other woman, if we save one other family, then our efforts have been worth it, and the children didn't die in vain," said Scapicchio. "And that's what keeps Lindsay going these days."
