Indonesian man gets 13 years’ jail for killing compatriot over daughter’s rape

An Indonesian man was sentenced to 13 years’ jail by the Tawau High Court today after pleading guilty to causing the death of a compatriot who raped his 12-year-old daughter.
Berita Harian reported that the 30-year-old man was previously charged with murder under Section 302 of the Penal Code but was given an alternative charge of culpable homicide under Section 304(a), which provides for up to 30 years’ imprisonment and a fine.
The court ordered the accused to serve his sentence from the date of his arrest on Sept 2, 2024, and to be referred to the immigration department after his release.
According to the charge, the father of six caused the death of a 33-year-old man at an unnumbered house in Tawau between 7.30pm on Aug 31, 2024 and noon on Sept 1, 2024.
The prosecution was led by Nur Nisla Abd Latif, while the accused was represented by Jhessery P Kang.
According to the facts of the case, the incident occurred after the accused’s daughter told her mother that she had been raped on the way home from an event.
Upon hearing this, the accused grabbed a parang and chased the man, cornering him near a chicken coop before slashing him several times.
A medical examination found tears in the daughter’s genital area, while a chemistry department analysis found that the deceased’s DNA was on her nails and matched DNA from semen found on her underwear.
Police arrested the accused at his home on Sept 2 and seized the parang used in the killing.
