Thirteen months after the murder of city lawyer Kyalo Mbobu, six suspects have finally been charged at the Kibera High Court.
Ms Rose mbithe Mulwa alias Rose Mbithe Ndetei, who is the ex-wife of psychiatrist Prof David Ndetei, her two children and two police officers denied executing Mbobu, a law lecturer at the University of Nairobi and an author of law books.
Appearing before Kibera High Court Judge Diana Kavedza, Ms Mulwa, her two children Chris and Angela Mulwa, and police constables Julius Kipkoech Cheruiyot and Kennedy Kipkeboi Borboroi, denied murdering Lawyer Mbobu on September 9,2025 at 17:30 hours along Magadi Road near in Karen Nairobi County.

Makori told the court that Sang had been on the run since the double murders of Mbobu and Doctor Victoria Mutiso in the city. He was arrested on October 24, 2026, at Eldoret city while selling his car after he ran out of money.
The court heard that Sang is currently undergoing processing and further interrogation where more evidence has emerged over the murders.
Makori also informed the court that they will be opposing the release of the all the accused persons on bond pending trial.
Defence lawyers led by Joel Mbaluka and Black Omanga applied for release of accused on bond saying were ready to make an oral bail application.
But Justice Kavedza overruled them, ordering them to file a formal bail application and written submissions within 10 days.
The defence lawyers insisted on making an oral submission on bond claiming the accused have been in custody since July 29, 2026 following the killing of clinical psychiatrist Dr Victoria Mutiso. The judge at that juncture chased the lawyers out of court to "cool down" after opposing the DPP's bid to file an affidavit opposing the release on bail of Rose Mbithe, her children Chris and Angela Mulwa and two police officers.
The lawyers Joel Mbaluka and Black Omanga became emotional and restless when prosecuting counsel Jalson Makori and Gikui Gichuhi asked the court to indulge them to put in an affidavit detailing the reasons for opposing Mbithe and co-accused to be admitted to bond.
The lawyer told Justice Diana Kavedza that the DPP's request is illegal, improper and unconstitutional and affront to the accused rights to bond.
Omanga told the judge that the DPP had three weeks to file the affidavit after registering the charges against their clients.
"I feel a bit offended the DPP is making the application to be allowed more time to put in an affidavit opposing bail now," lawyer Omanga said.
The judge intervened at that juncture telling Omanga and the rest of the defence lawyers to stop being emotional.
"Omanga please stop being emotional, please go out all of you and cool down, just the moods. Please remember the ethics of addressing the court," Justice Kavedza ordered.
Bail application
After 10 minutes the judge called back the lawyers alongside the prosecution team and the case was fixed for bail application on November 24.
The judge further ordered the DPP to file the affidavit by Sergeant Joseph Omwenga within three days and file written submissions within 7days.
The court also granted the probation officers three weeks to interview the accused persons and the family of the victims.
The judge fixed the case for virtual mention for compliance in gilling the pleadings and pre-bail reports on November 19,2026.
She further fixed the case for bail hearing November 24,2026.
The judge also warned and cautioned the defence lawyers not to cause anxiety to the accused persons in their release on bond.
"These accused persons are just like any other remandees who are waiting for their matters to be determined. Justice is blind and slow in Kenya," justice Kavedza said
She told the accused to be patient on their bail adding that she will determine their matter in accordance to the law.
"Let your clients be patient as all remandees are equal before the lawyer as we have other high-profile murders against Sarah Wairimu Cohen, the late MP Ong'ondo Were, former OCS central Samson Talaam and the infamous Kolombote charged with murdering patients at KNH who are still in custody," the judge said. All the accused were remanded in prison custody until November 24, 2026.
