Ex-TH Properties deputy general manager charged again with CBT

A former deputy general manager of Tabung Haji (TH) subsidiary TH Properties Sdn Bhd has claimed trial to criminal breach of trust (CBT) involving RM14,000 in construction penalties related to a commercial building project owned by TH.

Tengku Kamarolhisham Tengku Kamaruddin, 55, pleaded not guilty after the charge was read before Kota Bharu sessions court judge Dazuki Ali, Berita Harian reported.
He is accused of colluding with THP Timur Sdn Bhd construction manager Hashim Mukhatap, 53, to commit CBT by transferring the RM14,000 in penalties imposed on Kelpile Sdn Bhd to Hashim’s bank account.

THP Timur is a subsidiary of TH Properties.

Tengku Kamarolhisham is accused of committing the offence at Sofea Residensi in Seksyen 12, Kota Bharu, between November 2017 and August 2018.

The charge under Section 409 of the Penal Code is punishable by two to 20 years in prison, whipping and a fine, upon conviction.

Deputy public prosecutor Asmah Che Wan prosecuted while Tengku Kamarolhisham was represented by Fahmi Abd Moin.

Fahmi sought bail of RM5,000, saying his client only earned RM5,000, had to look after his six children and suffered from heart issues and diabetes.

The court fixed bail at RM8,000 and ordered Tengku Kamarolhisham to report to the Malaysian Anti-Corruption Commission every month. Dazuki set Oct 19 for mention.

Earlier this month, Tengku Kamarolhisham was charged with three counts of abetting in CBT involving RM72,000. He was charged with committing the offences as former deputy general manager of TH Properties and THP Bina Sdn Bhd, another subsidiary of the former.
