Suspended deputy national police commissioner Shadrack Sibiya is facing an additional firearm-related charge, his attorney told the Randburg Magistrate’s Court on Thursday.

Sibiya is applying for bail after his arrest on charges of rape, sexual grooming of a child, promoting sexual grooming of a child, and trafficking in persons.

Rashaad Moosa, who is part of Sibiya’s legal team, told the court that he had been informed by the investigating officer that a separate case had been registered against Sibiya relating to a firearm.

Moosa said Sibiya had also been asked to provide a warning statement regarding the firearm charge, which relates to a gun that was found on 21 September when he was arrested.

“The issue, as I understand it, is that General Sibiya, on the day of his arrest, had a firearm with him. It was stored in his vehicle.

“The State is now alleging a contravention ... of the Firearms Control Act. I think the issue related to the storage of the firearm on the day of his arrest, in the sense that the firearm was not stored in a safe – it was located in a vehicle,” he told the court.
