Tribunal orders former director of a Sabah hospital to apologise, pay RM10,000 over sexual harassment complaint

KOTA KINABALU, Sept 23 — A former Sabah hospital director has been ordered by the Tribunal for Anti-Sexual Harassment (TAGS) to pay RM10,000 in compensation to a woman who lodged a police report alleging sexual harassment against him.

His counsel Joan Goh (pic) said TAGS also ordered her client to apologise to the woman and pay the compensation via bank transfer within 30 days of the award dated Sept 18.

She said the apology must be sent to the woman via the TAGS email address, while two witnesses for the woman and five for the respondent testified during the hearing.

Goh said her client would challenge the Tribunal’s decision in the High Court through judicial review and seek a stay of the award pending determination of the challenge.

“The respondent maintains that the decision is legally unsustainable and raises serious issues warranting consideration by the High Court, including whether the Tribunal took into account irrelevant considerations and evidence in arriving at its findings, and whether the relevant statutory requirements for a finding of sexual harassment were properly considered and applied,” she said. — Daily Express
