2 charged over assault that left man with dislocated arm

KUALA LUMPUR: An unemployed man and a lorry driver were charged at the magistrate's court here with voluntarily causing grievous hurt to a man who suffered a dislocated right arm.
Muhammad Hafizi Rosli, 33, and Ahmad Izha Mohd Hanif, 31, pleaded not guilty after the charge was read before magistrate Amalina Johar.
They were accused of kicking and punching the victim at the basement car park of a club at Metro Pudu at 3.05am on Sept 27.
The victim suffered a dislocated right arm, bruises to his face and scratches on his back.
The charge under Section 325 of the Penal Code, read with Section 34, carries a maximum seven-year jail term and a fine upon conviction.
Deputy public prosecutor Amritpreet Kaur Randhawa proposed bail of RM7,000 with one surety for each accused and applied for an order preventing them from harassing the victim.
The two accused, represented by the National Legal Aid Foundation, appealed for lower bail.
The foundation said Hafizi was single and had recently lost his job, while Ahmad Izha earned RM1,600 a month and supported his wife and three children, aged eight, seven and five.
Amalina allowed each accused bail of RM6,000 with one surety and ordered them not to interfere with the victim or any prosecution witnesses until the case is disposed of.
In a separate case, a 19-year-old warehouse worker pleaded not guilty to using criminal force with intent to outrage the modesty of a 17-year-old girl last month.
He was accused of committing the offence at a house in Seri Petaling at 5am on Sept 26.
The charge under Section 354 of the same code carries a maximum 10-year jail term, a fine, whipping, or any two of the punishments upon conviction.
Amritpreet asked the court to set bail at RM6,000 with one surety and for the accused to refrain from harassing the victim.
The foundation requested lower bail, saying the teenager, who had stopped schooling after Form Four, earned RM1,700 a month and supported his elderly parents.
Amalina allowed bail at RM3,000 with one surety and ordered the accused not to harass the prosecution witnesses until the case is disposed of.
