Crypto traders liable for lost consumer assets, OJK says

Jakarta (ANTARA) - The Financial Services Authority (OJK) stressed that crypto asset traders must maintain security and bear responsibility if consumers’ digital financial assets stored by the traders are lost.
OJK Chief Executive for Financial Sector Technology Innovation, Digital Financial Assets, and Crypto Assets Supervision, Adi Budiarso, said the provision is part of consumer protection against asset loss risks caused by trading system security breaches.
"Traders are required to maintain security and be responsible if consumers’ digital financial assets stored by the traders are lost," Budiarso said at an online press conference here on Thursday (Nov 5).
The obligation is regulated in Article 91 Paragraph (1) of OJK Regulation (POJK) Number 27 of 2024 on the Implementation of Digital Financial Asset Trading, Including Crypto Assets, as amended by POJK Number 23 of 2025.

Budiarso explained OJK also regulates asset storage mechanisms to strengthen security and reduce asset loss risks in the crypto trading ecosystem.
Under the provision, traders may store themselves a maximum of 30 percent of consumers’ digital financial assets, while the rest must be placed with a storage manager or custodian.
Of the assets stored by the trader, at least 70 percent must be placed in offline storage (cold storage), while a maximum of 30 percent can be stored online (hot storage).
Besides traders, storage managers must also maintain security and bear responsibility if digital financial assets they store are lost, as regulated in Article 92 Paragraph (2) of the POJK.

However, he said, the form and mechanism of settling losses from asset loss must consider examination results, the cause of the loss, and applicable provisions.
OJK made the statement amid attention to a cybersecurity incident involving Binance and its potential impact on public trust.
According to Budiarso, the incident served as a reminder for crypto asset trading providers to keep strengthening information technology governance, access control, human resource competence, and internal supervision.
"This cybersecurity risk is a global challenge," he said.
