Rodrigo Duterte, mananatiling nakakulong -- ICC trial chamber

THE HAGUE – Nagkakaisang nagpasiya ang International Criminal Court (ICC) Trial Chamber III na panatilihing nakakulong si dating Pangulong Rodrigo Duterte.

Sa isang desisyong inilabas ilang saglit matapos ang ikatlong status conference, natuklasan ng Chamber ang posibilidad na “absconding and/or obstructing or endangering the investigation or the court proceedings” si Duterte.

“In respect of the latter considerations, owing to the Prosecution’s submission of the Witness and Evidence Lists, (thereby disclosing the identities of the witnesses and the contents of their expected testimony), this increases the Accused’s ability to interfere with witnesses, either directly or through his family or supporters in the Philippines,” saad sa desisyon.

Nabanggit ng Chamber na hindi pa ito nagpapasya kaugnay sa isyu ng kalusugan ni Duterte, sa gitna ng hiniling ng depensa para sa “greater medical certainty” habang kinukuwestiyon ang ulat ng panel ng eksperto.

Gayunpaman, sinabi ng Chamber na hindi nagbibigay ng “any information that constitutes new facts or a change in circumstances” ang mga obserbasyon ng mga abogado ni Duterte, na nangangailangan ng pagbabago sa kaniyang detensiyon.

Hinihiling ng ICC Office of the Prosecutor sa Trial Chamber III na iutos ang patuloy na pagdetine kay Duterte, na pinuntong "necessary" ito para hindi siya mag-“interfere with witnesses.”

Sinabi ni Acting Prosecutor Mame Mandiaye Niang na “there has been no change” sa mga kalagayan ni Duterte na mag-uudyok sa Trial Chamber III na baguhin ang nauna nitong utos sa pagpigil sa dating pangulo.

“To the contrary,” binanggit ni Niang sa isang obserbasyon na inihain noong Setyembre 14, “there have been changes in circumstances that have increased the risk Mr. Duterte presents under articles 58(1)(b)(i) and (ii) of the Statute.”

Tinutukoy ni Niang ang artikulo ng Rome Statute tungkol sa pag-isyu ng warrant of arrest, na tinitiyak ang pagharap ng isang taong nahaharap sa mga kaso sa isang paglilitis, at “does not obstruct or endanger the investigation or the court proceedings” ang naturang tao.

Samantala, dumalo si Duterte, sa unang pagkakataon nitong Miyerkoles, Setyembre 16, 2026, sa status conference ng ICC sa kaniyang kasong crimes against humanity.

Ayon sa GMA stringer na si Andy Peñafuerte III, nakaupo na si Duterte nang dumating ang mga hukom.

Hindi kagaya ng nakaraang dalawang pagdinig, hindi tumanggi si Duterte sa kaniyang pagharap.

“This is the first time that Mr. Duterte has been in this court. As far as the trial chamber is concerned, if he wishes to leave for any reason, he may do so,” sabi ni Presiding Judge Joanna Korner.

Nakatakdang magsimula ang paglilitis kay Duterte sa Nobyembre 30.

Nahaharap siya sa mga kasong krimen laban sa sangkatauhan kaugnay ng mga pagpatay umano noong siya ay Pangulo at alkalde ng Davao City.

Naaresto si Duterte noong Marso 2025 sa Ninoy Aquino International Airport Terminal 3 at kasalukuyang nakakulong sa ICC Detention Centre sa Scheveningen sa The Hague, The Netherlands. —Andy Peñafuerte III/Jamil Santos/VBL GMA News
