KUALA LUMPUR: Malaysian Border Control and Protection Agency (MCBA) director-general Datuk Seri Mohd Shuhaily Mohd Zain will be charged at the Sepang Magistrate's Court tomorrow over an an alleged assault involving two policemen at Kuala Lumpur International Airport (KLIA) Terminal 1 on Sept 28.

A source said Shuhaily would be charged under Section 323 of the Penal Code for voluntarily causing hurt to the two policemen.

On Oct 17, Home Minister Datuk Seri Saifuddin Nasution Ismail said the Attorney-General's Chambers (AGC) had recently returned the investigation papers to the police for further action.

He said the A-GC had requested several improvements to the investigation papers before deciding on the next course of action.

"The police are still completing the investigation. The AGC informed us that several improvements need to be made to the investigation papers.

"The investigation papers contain statements recorded from witnesses and all information gathered during the investigation before they were submitted to the AGC.

"The AGC must be fully satisfied with the findings of the investigation before making a decision. Usually, if it is not satisfied, the AGC will return the investigation papers to the police for further action," he said.

Saifuddin Nasution said the police had been directed to complete the investigation in accordance with the AGC's requirements.
