Indonesia reviews Anti-Corruption Law to align with UNCAC

Translate

Jakarta (ANTARA) - The Indonesian government reviews potential revisions to the Anti-Corruption Law to harmonize domestic legislation with the United Nations Convention against Corruption (UNCAC) and fulfill mandatory criteria for OECD accession by 2028.

Coordinating Minister for Legal, Human Rights, Immigration, and Correctional Affairs Yusril Ihza Mahendra spoke about the reviews after discussing it with President Prabowo Subianto regarding a proposal by the National Economic Council (DEN) to update the definition of corruption outlined in Law Number 31 of 1999 and Law Number 20 of 2001.

"We have ratified the convention. It does not take effect automatically; rather, its content must be incorporated into our own national laws," Minister Mahendra told reporters at the Presidential Palace in Jakarta on Monday (Oct 26).

He noted that certain acts classified as corruption under the UNCAC, including foreign bribery, are not currently defined as such under Indonesian law.

Establishing explicit foreign bribery rules is a vital prerequisite for full membership in the Organisation for Economic Cooperation and Development (OECD) by 2028.

Meanwhile, Coordinating Minister for Economic Affairs Airlangga Hartarto previously underscored that strengthening cross-border regulatory frameworks is vital to support Indonesia in expanding global trade and economic integration.

In addition to the international standards, Mahendra noted any legislative overhaul must align smoothly with the updated Criminal Code (KUHP), the Criminal Procedure Code (KUHAP), and the ongoing deliberations surrounding the Asset Forfeiture Bill.

While President Prabowo has not yet formally approved the DEN’s amendment proposal, Mahendra has ordered a thorough, in-depth study to evaluate how international definitions fit Indonesia’s domestic landscape.

Crucially, the administration maintains the legal element of "state financial loss" must be firmly preserved.

He revealed foundational alignment analyses were originally drafted back in 2006 by the then-Department of Law and Human Rights, the Foreign Affairs Ministry, and the Corruption Eradication Commission (KPK).

The proposed revision will undergo further governmental review before being slated for inclusion in the National Legislation Program, determining whether the legislative initiative will be advanced by the government or the House of Representatives (DPR).
