[UPDATED] A-GC denies defying King's pardon, dismisses treason claims

KUALA LUMPUR: The Attorney-General's Chambers (A-GC) has denied defying the Yang di-Pertuan Agong's conditional pardon for Datuk Seri Najib Razak and dismissed allegations of treason by his lawyers as baseless.
"The A-GC has not in any way disputed, set aside or intended to suspend the conditional pardon granted by His Majesty the King," it said in a statement.
It maintained that seeking judicial clarification on the implementation of Najib's house arrest did not amount to questioning the King's constitutional power of pardon.
The A-GC said the royal prerogative of pardon under Article 42 of the Federal Constitution and the courts' authority to determine the legal effect of an order were separate matters.
"Obtaining a court decision on the implementation of an order does not in any way mean questioning the authority of the party that issued the order," it said.
The A-GC said ensuring that a pardon was implemented correctly and in accordance with existing court orders was part of upholding the monarchy and the rule of law, rather than defying the King's decree.
The statement was issued in response to Najib's lawyers, Messrs Shafee & Co, who last night accused the A-GC of executive overreach and disregarding the King's decree by seeking to delay his transfer to house arrest.
The lawyers alleged that the Attorney-General's position amounted to contempt and possibly treason against the King.

They also questioned why the A-GC had waited seven weeks after the Sept 18 pardon before raising concerns over its interpretation.
The legal team maintained that if the A-GC required clarification, it should apply to the High Court rather than delay Najib's transfer.
The dispute arose after Najib's RM50 million fine was paid in full at the Kuala Lumpur High Court yesterday, fulfilling a condition of the royal pardon.
The pardon allows Najib to serve the remainder of his SRC International prison sentence under house arrest until Aug 23, 2028.
However, the A-GC later proposed a temporary deferment pending clarification of the High Court's discharge order and its implications for Najib's separate 1Malaysia Development Berhad (1MDB) prison sentence.
