Impeachment court: Sara Duterte, hindi mapipilit na aminin ang pag-aari sa mga bank account

Nagpasya ang Senate impeachment court nitong Martes na hindi mapipilit si Vice President Sara Duterte na aminin na nagmamay-ari siya ng mga bank account kung saan isinumite ang mga record sa kaniyang impeachment trial.

Lumabas ang desisyon matapos bawiin ng House prosecution panel ang request for admission nitong Lunes at sa halip, hiniling sa depensa na sumang-ayon sa mga probisyon, o kasunduan, sa pagiging tunay ng bank records.

“The impeachment court, therefore, rules that respondent cannot be required to serve a written response to the request for admission,” sabi ni Presiding Officer Francis “Chiz” Escudero.

Sakop ng request for admission ng prosekusyon ang 104 mga bagay patungkol sa personal na kalagayan ni Duterte at mga dating pampublikong posisyon, mga interes sa negosyo ng kaniyang asawa, at iba't ibang record sa bangko.

Tumutol ang defense team ni Duterte sa request, at hiniling na burahin ang usapin mula sa mga record ng impeachment court.

Matapos bawiin ang motion for admission, hiniling ng House prosecution panel sa defense na sumang-ayon sa mga kondisyon na mayroong mga bank account, na ginawa ang mga record ng mga bangko alinsunod sa mga subpoena na inisyu ng impeachment court, at “genuine” at “authentic” ang mga kopya ng mga pinananatili at ginawa ng mga bangko.

Sa kanilang bahagi, sinabi ng impeachment court na sa kabila ng pagbawi ng request, nakita nitong kinakailangang tugunan ang mga isyung itinaas nito para gabayan ang mga partido sa mga susunod na paglilitis.

“The respondent’s objection to the application of Rule 26 is sustained. Respondent need not answer the request for admission and her failure to answer shall not be deemed an admission,” Escudero said.

“However, her prayer to expunge the request is denied. The request, the objection, and this ruling shall remain in the record as part of the proceedings but with the admonition and reminder to senator-judges that the request for admission shall have no evidentiary, factual, or prejudicial effect against the respondent,” dagdag niya.

Karapatan laban sa self-incrimination

Sinabi ni Escudero na ang Rule 26 ng Rules of Civil Procedure ay hindi maaaring manaig sa Section 17, Article III ng Konstitusyon, na nagpoprotekta sa karapatan ng isang tao laban sa self-incrimination.

Isinasaad sa Rule 26 na “after the issues have been joined, a party may serve upon another party a written request for admission of the genuineness of material and relevant documents, or of the truth of material and relevant matters of fact.”

Samantala, isinaad sa Section 17 ng Artikulo III na “no person shall be compelled to be a witness against himself.”

“Being part of the Bill of Rights, the right against self-incrimination remains protected even under impeachment process as held in Duterte v. House of Representatives,” sabi ni Escudero.

Binanggit din niya ang hurisprudensiya na nagsasabing ang pag-aatas sa isang respondent na sumagot sa mga tanong tungkol sa material and relevant matters of fact ay maaaring maituturing na pag-uudyok sa respondent na maging saksi laban sa kaniyang sarili.

Binanggit ni Escudero na hinihiling din ng Rule 26 na gawin ang tugon “under oath,” na naglalantad sa partido sa karagdagang panganib na mapapanagot sa perjury, na bumubuo aniya ng isa pang uri ng pamimilit.

“While the impeachment court welcomes the prosecution’s desire to narrow the issues for trial, identify matters genuinely in dispute, and avoid unnecessary proof of uncontroverted matters, any such measure to expedite the proceedings must always yield to the protection of the substantial rights of the respondent under the Constitution,” sabi niya.

Sinabi rin ni Escudero na hindi maaaring gamitin ang pagkakatuklas bilang kapalit ng paglalahad ng karampatang ebidensya.

Aniya, nananatiling responsable ang prosekusyon sa pagtatatag ng mga kaso sa pamamagitan ng karampatang ebidensya, habang dapat bigyan ang respondent ng pagkakataong tutulan ang naturang ebidensya.

“The prosecution cannot shift its burden of proof to the respondent through the simple expedience of a request for admission,” ani Escudero.

Tinanggihan din niya ang argumento ng prosekusyon na hindi isang kriminal na paglilitis ang impeachment, ay nag-aalis sa mga konstitusyonal na pagtatanggol na ibinibigay sa respondent.

“Gutierrez v. House of Representatives ... explains that impeachment is analogous to a criminal trial. Although it is not a criminal prosecution,” sabi niya.

Nagpepresenta ang House prosecution ng ebidensya sa ikalawang artikulo ng impeachment, na inaakusahan si Duterte ng pag-iipon ng hindi maipaliwanag na kayamanan sa pamamagitan ng pagkabigo umanong ganap at tapat na ilahad ang mga asset at liabilities sa kaniyang mga Statement of Assets, Liabilities and Net Worth, pati na rin ang pagkabigo umanong mag-divest mula sa mga interes sa negosyo habang nagsisilbi bilang bise presidente.

Hiningi ng prosekusyon ang pag-amin ni Duterte tungkol sa mga record ng bangko na ipinatawag ng impeachment court bilang bahagi ng paglalahad nito ng ebidensya sa mga paratang ng hindi maipaliwanag na kayamanan. — VBL GMA News
