Judge dismisses plea for dropping suit against Sam Smith and Normani

The Rolling Stone reported that a judge has officially dismissed Sam Smith and Normani’s plea to drop the lawsuit that has been filed against their song, ‘Dancing with a Stranger.'

A 27-page-long ruling was filed on Wednesday by a federal judge in Los Angeles, who rejected the official plea that both of the singers had filed. The initial suit was appealed to court by Jordan Vincent, Christopher Miranda, and Rosco Banlaoi.The case had already been dismissed once; however, it had been revived after another appeal was filed in court. Now, according to the judge, the two must face a jury trial over accusations of copying a 2015 song with 2019 songs.

According to the reports shared online, Judge Wesley L. Hsu filed against the singer’s appeal, stating that there were not enough reasons to cancel the case. A statement from the judge revealed, “The court finds the question of independent creation should be left for the jury to decide.

The two songs should be presented to a jury."According to the filing, the singers alleged that the songs had no copyright over them yet, though the judge dismissed this commentary and shared that they had no legal proof for their claims to dismiss the plea.

Another statement read, “The samples are both difficult to identify or even hear within Plaintiff’s song due to their low volume. As a result, the average audience could very well fail to recognize the appropriation of the sampled songs when listening to plaintiff’s song.
