Retired police major general Mao Aplasca, former acting Senate sergeant-at-arms, on Wednesday filed his counter-affidavit with the Department of Justice (DOJ) in connection with a direct assault complaint over the May 13 Senate shooting incident.

“He submitted his counter-affidavit today,” Justice spokesperson Polo Martinez said in an ambush interview.

The complaint was filed by the Philippine National Police-Criminal Investigation and Detection Group (PNP-CIDG).

According to Martinez, the PNP-CIDG is given until November 6 to file its reply affidavit.

“So option po ‘yun sa PNP-CIDG. They don’t have to, but they can. And if they do file their reply affidavit, then the respondents, Mao Apalsca as well as two other respondents forming part of the OSAA, will also then have the chance to file their rejoinder affidavit,” he said.

Martinez said that if the PNP-CIDG will not file a reply affidavit on November 6, the complaint will be submitted for resolution.

To recall, Aplasca fired warning shots on May 13 while the upper chamber was on lockdown, sending Senate personnel, media practitioners, and other civilians inside the Senate premises into panic and chaos.

In July, the Ombudsman ordered the dismissal of Aplasca because of grave misconduct and gross neglect of duty over the shooting incident. —AOL, GMA News
