Embu chaos: Court win for Manyatta MP Mukunji in bid to block arrest

Manyatta MP Gitonga Mukunji has been granted anticipatory bail of Sh1m or Sh500,000 cash bail over anticipated arrest linked to Saturday's deadly violence during DP Kindiki's political meeting in Embu.

In his ruling, Justice Magare Dennis Kizito Ngwono certified the application as urgent.

He ordered that the application be served to all the respondents by close of business on September 16, 2026.

The respondents are expected to file their response on September 23, 2026.

The anticipatory bail was granted on condition that Mukunji reports to the Directorate of Criminal Investigations(DCI) in Nairobi on September 21, 2026.

However, Justice Ngwono clarified that the anticipatory orders don't bar police from investigating Mukunji and charging him.

The matter will come up for directions on September 29.

Meanwhile, Mukunji has denied being involved in causing chaos which left two people dead and property destroyed during a political meeting at Nembure Stadium in Embu County.

In a letter to the National Police Service dated September 25, 2026, Mr Mukunji said he learnt with profound concern, through a public statement made by Mr Charles Owino, the Government Spokesperson, that the National Police Service is allegedly pursuing him in connection with the tragic events that occurred at Nembure.

Through his lawyer, Ndegwa Njiru, Mr Mukunji said this assertion stands in stark and inexplicable contradiction to previous clear indications by the Police that he was not a subject of any such investigation or pursuit.

"I therefore left in a state of complete and justified bewilderment as to which of the two conflicting positions is the official and truthful stance of the State; that of the Government Spokesperson, Mr Charles Owino or that of the Police Spokesperson, Mr Michael Nyaga Muchiri. This deliberate or reckless dissemination of contradictory public messaging constitutes a grave assault on my constitutional rights to dignity, security of the person, and fair administrative action, and has subjected both me and my family to intolerable anxiety, fear, and uncertainty," he said.

"In the strongest possible terms, I  condemn the said incident in its entirety."

Mr Mukunji demanded that the National Police Service immediately institute and conduct a thorough, transparent, independent, and wholly impartial investigation into the events at Nembure Ground, free from political interference, sideshows, selective prosecution, or any other extraneous considerations.

Mr Mukunji claimed that DP Kindiki was heard issuing orders to the police during the meeting and that he should be investigated.

"It is a matter of public record that Mr. Abraham Kithure Kindiki was heard issuing such orders. Under Article 27 of the Constitution of Kenya, 2010, indicates that nobody is above the law. Article 143 of the Constitution of Kenya, 2010, makes it abundantly clear that Mr Abraham Kithure Kindiki enjoys no immunity from criminal prosecution. These questions go to the very heart of the rule of law and the constitutional duty of the National Police Service to protect, rather than endanger, the lives of Kenyan citizens. Any attempt to deflect, obscure, or suppress the truth in this regard shall be resisted with the full force of the law," said Mr Mukunji.
