Jon Gruden’s NFL Lawsuit Takes A Troubling Turn As Judge Questions His Credibility

Jon Gruden spent years fighting to get his day in open court. Now that he has it, the room is turning against him. A judge has openly doubted his word, ordered him to cover part of the NFL's legal bills and asked pointed questions about a BlackBerry that may or may not exist. Sportico's Michael McCann obtained the hearing transcript, and it reads like a warning. The former Raiders coach sued the league five years ago over leaked emails. His own conduct in discovery may now hurt him more than anything the NFL has done.

Why is the Jon Gruden BlackBerry such a problem?

Gruden first beat the NFL's push to move his case into league-run arbitration. That win put his claims in front of Judge Joe Hardy. In August, the judge already criticized Gruden and his lawyers for failing to follow the rules. The latest hearing went further.

The dispute centers on an old BlackBerry. Gruden's attorney, Adam Hosmer-Henner, told the court the device was a mistake, not a lie. He said Gruden described a phone he could not turn on. Judge Hardy asked whether anyone on the legal team had checked that the phone existed. Nobody had. Hosmer-Henner explained that Gruden lives in Florida and that his firm did not send anyone to search the house.

The attorney also pointed out that Gruden flew home from a White House event so the NFL's forensic examiners could review his devices. That did not land well. The judge said the process was frustrating and made clear he did not see why the court should bend around Gruden's schedule. Then he said it plainly: "We have no reason to trust representations by Mr. Gruden."

What does the ruling mean for Gruden's NFL lawsuit?

Judge Hardy ordered Gruden to pay a share of the attorneys' fees the NFL spent trying to get him to comply. That is rare in a civil case. It shows how far the judge's patience has run down.

The timing hurts. This same judge will make many of the key calls in the case. If it reaches trial, Gruden will testify in front of him. Gruden is known for a strong will, a quick temper and a salty vocabulary, and a judge who already doubts him will watch every word.

Gruden's core claim is serious. He says someone tied to the NFL used confidential emails from an unrelated investigation to push him out of his Raiders job in 2021. But the emails themselves were damaging, so he starts with a weak hand. Proving his case gets much harder if he looks like he is dodging the process.

Worse, a hidden device could hold messages that harm him further. Unless Gruden rebuilds the court's trust, he risks losing the case and possibly owing the league millions in defense costs.
