LSK links missing Nairobi lawyer to criminal case, demands urgent investigations

Translate

NAIROBI, Kenya, Nov 3 — The Law Society of Kenya (LSK) has raised concerns that the disappearance of Nairobi advocate Abshir Ahmedsadak Abdi may be linked to his role as a key witness in a criminal case, calling for urgent investigations and his immediate production.

In a statement, LSK President Charles Kanjama said Abdi, of Abshir & Njagi Advocates, was reportedly abducted by armed men along Muchai Road, off Ngong Road, on the morning of November 2, 2026.

The Society said the lawyer was pursued by two vehicles, a Toyota Prado TX and a double-cab vehicle, whose occupants were reportedly armed.

Some of the individuals were allegedly dressed in what appeared to be police uniforms and bulletproof vests.

His vehicle was later recovered along the same road, but his whereabouts remain unknown.

LSK said it was particularly concerned by reports that Abdi’s disappearance could be connected to his involvement in Criminal Case No. MCCR/E2910/2025, Republic v Ahmed Ali Mohamed, before the Makadara Law Courts, where he is reportedly a complainant and key witness.

The Society said it had also received earlier correspondence raising allegations of threats and intimidation linked to the same proceedings, which it said warranted urgent, independent and impartial investigations.

“The abduction and disappearance of an Advocate in circumstances that may be connected to the discharge of their professional duties is an affront to the administration of justice, the independence of the legal profession and the rule of law,” Kanjama said.

The incident was reported at Kilimani Police Station under OB No. 55/1/11/2026.

LSK called on Inspector General of Police Douglas Kanja to take immediate action to establish Abdi’s whereabouts and secure his safe return.

It also urged the Directorate of Criminal Investigations (DCI) to conduct thorough investigations, identify those involved, and preserve all available evidence, including CCTV footage and witness accounts.

The Society further called on the Independent Policing Oversight Authority (IPOA) to investigate the reported involvement of individuals posing as police officers and establish whether serving officers or other State agents were involved in, facilitated or sanctioned the incident.

LSK said anyone found culpable should be held personally accountable, regardless of their position or office.

The Society noted that a habeas corpus application had been filed in court seeking orders concerning Abdi’s disappearance, with the matter scheduled for directions on November 9, 2026.

It urged the court to consider the application expeditiously and called for full compliance with any orders issued.

Citing Article 29 of the Constitution, LSK said every person is entitled to freedom and security, including protection against arbitrary deprivation of liberty.

It warned that threats, intimidation and abductions targeting advocates over their professional duties undermine the administration of justice and the ability of lawyers to participate freely in judicial proceedings.

The Society demanded Abdi’s immediate and unconditional production if he is being held by any State agency or other person, saying it would pursue all necessary legal and institutional interventions to secure his return.
