Ossy Dermawan wants Agrarian Reform Bill to serve social justice

Jakarta (ANTARA) - Indonesia's Deputy Minister of Agrarian Affairs and Spatial Planning, Ossy Dermawan, said the Agrarian Reform Regulation Bill must become an instrument for delivering social justice.

"We hope this bill will not merely become an ordinary administrative regulation, but also transform into a legally binding instrument of social justice," Dermawan said in a statement here on Wednesday.

He proposed several points to strengthen the bill's content, including reinforcing the objectives of agrarian reform, regulating the scope of Agrarian Reform Land Objects (TORA) sources, categorising and prioritising TORA recipients, and provisions on asset and access arrangement.

Regarding asset arrangement, Dermawan stressed it needs to proceed alongside access arrangement. He said this would ensure that land received by communities not only provides legal certainty, but also improves welfare.

"It means people should not receive land from the state, then sell it to businesspeople, and end up trapped again in the cycle of poverty. These are things we need to avoid," he stressed.

Dermawan wants the resolution of agrarian conflicts regulated more clearly in the bill, including detailed conflict typology and resolution mechanisms.

Strengthening the bill should also cover institutional aspects, he added, saying there needs to be clarity on the relationship and division of authority should the bill mandate the establishment of an Agrarian Reform Implementing Agency.

Moreover, monitoring, control, reporting, sanctions, funding, and budget allocation should also need to be regulated, so that agrarian reform implementation has a clear legal basis and mechanism.

He considered clarity on institutional and authority aspects important, because agrarian reform implementation involves multiple sectors and is closely tied to land tenure and utilisation issues, including those related to forest areas.

Therefore, deliberation of the bill must pay attention to the existing land and forestry policies to prevent potential overlap in agrarian reform implementation.
