KUALA LUMPUR, Oct 1 — The Kuala Terengganu High Court today awarded RM47,000 in damages and costs to a boy, now 13, who suffered a broken right leg in an incident involving a Quran and Fardu Ain (KAFA) teacher four years ago.

Judge Yusrin Faidz Yusoff allowed Muhammad Izz Anaqi Mohd Izwan’s appeal and set aside an earlier Sessions Court decision that had dismissed his claim, Utusan Malaysia reported.

The judge found that the lower court had erred by failing to properly assess the testimony of two eyewitnesses and a specialist medical report from Sultanah Nur Zahirah Hospital.

“The judge failed to assess the evidence of two eyewitnesses and the specialist medical report from Sultanah Nur Zahirah Hospital. The medical report confirmed that the pupil’s [the plaintiff’s] leg injury was caused by a forceful impact,” Yusrin Faidz said in delivering his judgment.

The High Court ordered KAFA teacher Ahmad Mursyidin Abdullah, 41, and his employer, Yayasan Islam Terengganu (YIT), to pay RM30,000 in general damages for the boy’s injuries and RM17,000 in costs, together with interest.

Yusrin Faidz also ruled that YIT was vicariously liable for the injuries suffered by the boy as a result of the teacher’s actions.

According to the statement of claim filed through Muhammad Izz Anaqi’s mother, Nor Azlina Mohamad Yasin, 41, Ahmad Mursyidin allegedly slammed the boy onto a chair at about 3.30pm on July 6, 2022.

The boy was unable to walk home after the class and was taken to a private clinic, where an X-ray confirmed that his right leg was fractured.

Muhammad Izz Anaqi, who is now a student at a Mara Junior Science College (MRSM), was represented by lawyers Mohammad Rafaei Adnan, Mohd Hazwan Hamidun and Alif Danial Ahmad Shahrulnizam.

Saifuddin Othman and Yuhana Junaidi represented the two defendants.
